Terms of Service

1. Acceptance of Terms

By accessing or using xoxo.bio (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service. We may update these Terms; continued use after changes constitutes acceptance of the revised Terms.

2. What xoxo.bio Is

xoxo.bio is a creator commerce platform. It lets you publish a link-in-bio page and storefront, sell digital products, courses, memberships and bookings, collect email subscribers, run email sequences, and automate Instagram comment replies and direct messages. We provide the software and payment infrastructure. We are not the seller or merchant of record for your products, and we are not a party to the contract between you and your customers.

3. Account Registration

• Provide accurate, current and complete information
• Keep your password and account secure
• Accept responsibility for all activity under your account
• Notify us immediately of unauthorized access

You must be at least 13 to create an account, and at least 18 (or the age of majority where you live) to sell products or receive payouts.

4. Usernames & Custom Domains

Each account has a unique username forming your public URL (xoxo.bio/username), assigned first-come, first-served. We may reclaim or reassign usernames that infringe trademarks, impersonate a person or brand, are reserved, or have been inactive for an extended period. If you connect a custom domain, you are responsible for owning it, maintaining its registration, and configuring the DNS records we provide.

5. Plans, Trials & Billing

• xoxo.bio is a paid product with a free trial. Access to the dashboard and your published page depends on an active trial or subscription.
• Subscriptions are billed in advance through Stripe on a recurring basis until cancelled.
• You may cancel at any time; access continues to the end of the current billing period. Except where required by law, payments are non-refundable.
• If a trial ends or a payment fails and is not resolved, paid features and your public page may be disabled until billing is restored.
• We may change pricing with reasonable notice to existing subscribers.
• Plan limits, including limits on hosted video for free courses, apply as described in the product.

6. Payments, Stripe Connect & Platform Fees

Selling requires connecting a Stripe account. Your use of Stripe is governed by the Stripe Connected Account Agreement. Customer payments are processed directly to your connected account.

• xoxo.bio charges 0% platform commission on your sales. Stripe's own processing fees still apply and are set by Stripe.
• Payout timing, holds, identity verification and account eligibility are controlled by Stripe, not by us.
• You are the merchant of record for your sales. You are responsible for fulfilment, customer support, refunds, chargebacks and any resulting fees.
• You are responsible for determining, collecting and remitting all applicable taxes on your sales.
• We may withhold or reverse platform functionality where we reasonably suspect fraud, excessive chargebacks or illegal activity.

7. Your Obligations to Your Customers

• Describe products, pricing, comparison prices and delivery accurately, and honour what you advertise
• Publish and honour your own refund and cancellation policy
• Keep purchased content, courses and memberships available for the period you promised
• Attend or reschedule bookings your customers pay for
• Only email people who opted in, honour unsubscribes, and comply with anti-spam laws such as CAN-SPAM, CASL and GDPR
• Act as the data controller for your customer and subscriber data, and comply with applicable privacy law

8. Instagram & Third-Party Integrations

Connecting Instagram, Google, Stripe or any other third-party service is optional and subject to that provider's own terms and policies, including Meta's Platform Terms. You must own or be authorized to manage any account you connect, and your automated replies and direct messages must comply with Instagram's rules on spam and automation. Third-party APIs may change, rate-limit or become unavailable; we are not responsible for downtime, message delivery failures or account restrictions imposed by those providers.

9. Acceptable Use

You may not use xoxo.bio to:

• Post or link to illegal, harmful, threatening, abusive or hateful content
• Sell counterfeit goods, stolen content, or anything you lack the rights to sell
• Sell regulated or prohibited items, or anything Stripe's restricted businesses list forbids
• Distribute malware, phishing links or harmful software
• Impersonate a person or entity, or misrepresent an affiliation
• Send spam or unsolicited commercial messages, including via Instagram automations
• Run deceptive offers, fake scarcity or misleading earnings claims
• Scrape, crawl or automate access to the Service without permission
• Interfere with, overload or reverse-engineer the Service or its infrastructure
• Violate any applicable law

We may suspend or terminate accounts that violate these rules, with or without prior notice.

10. User Content

You retain ownership of everything you upload or create, including your profile, links, images, products, course videos and emails ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, transcode, display and distribute your User Content solely to operate and provide the Service, including delivery through our hosting and video providers.

You are solely responsible for your User Content and warrant that you hold all necessary rights and that it infringes no third-party rights.

11. Buyers & Access to Purchased Content

If you purchase from a creator, your contract for that product is with the creator, not with xoxo.bio. Access to downloads, courses and memberships is provided through your customer library for as long as the creator maintains the product and, for subscriptions, for as long as your membership remains active. Refund requests should be directed to the creator. Purchased content is licensed for your personal use and may not be redistributed.

12. Intellectual Property

The xoxo.bio name, logo, design, templates, code and features are our intellectual property and are protected by copyright and trademark law. You may not copy, modify, distribute or create derivative works of the Service without our written permission.

13. Copyright Complaints

If you believe content on xoxo.bio infringes your copyright, email hello@xoxo.bio with a description of the work, the URL of the infringing content, your contact details, and a statement that you are the rights holder or authorized to act. We remove infringing content and terminate repeat infringers.

14. Privacy

Your use of the Service is also governed by our Privacy Policy. Where we process your customers' data on your behalf, you appoint us as your processor and instruct us to process that data solely to provide the Service.

15. Service Availability

We aim to keep xoxo.bio available at all times but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Service. The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law.

16. Limitation of Liability

To the maximum extent permitted by law, xoxo.bio and its operators are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost sales, lost data or goodwill, arising from your use of the Service.

Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

17. Indemnification

You agree to indemnify and hold harmless xoxo.bio, its operators and affiliates from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your products and customer relationships, or your violation of these Terms.

18. Termination

We may suspend or terminate your account if you violate these Terms or act in a way harmful to the Service, other users or third parties. You may delete your account at any time from Settings. On termination your right to use the Service ends immediately, your public page is taken down, and we may delete your data in accordance with our Privacy Policy. You remain responsible for fulfilling outstanding obligations to your customers.

19. Dispute Resolution

Disputes arising from these Terms will first be addressed through good-faith negotiation. If unresolved, they will be settled by binding arbitration under applicable rules rather than in court, and you waive any right to participate in a class action or class-wide arbitration.

20. Governing Law

These Terms are governed by the laws of the jurisdiction in which xoxo.bio operates, without regard to conflict of law principles.
